Terms & Conditions
Effective November 1, 2026 · Last updated November 1, 2026
These Terms explain the rules for using the Flyby Exotics website and requesting our self-drive rentals and chauffeur service. Confirmed rentals are also subject to the signed rental agreement for that rental.
01Acceptance of these terms
These Terms & Conditions (“Terms”) govern your use of flybyexotics.com, its request forms and customer portal (the “Website”), operated by Flyby Exotics (“FLYBY EXOTICS,” “we,” “us”). By using the Website or sending a request, you agree to these Terms and acknowledge our Privacy Policy. If you don't agree, please don't use the Website.
Your rental agreement controls. These Terms are not a vehicle rental agreement. Every confirmed rental or chauffeur booking is subject to the rental agreement or booking terms you sign or accept for it. Where that agreement and these Terms differ on a rental-specific matter, the agreement controls to the extent permitted by law.
02Our business and the Website
Flyby Exotics offers self-drive rentals of exotic and luxury vehicles and private chauffeur service in Scottsdale, Phoenix and the surrounding Arizona valley. The Website lets you browse our fleet, send rental, chauffeur and partnership inquiries, create a customer account, upload licence and insurance documents, and follow the status of your requests. The Website does not take payments or make instant bookings.
03Rental eligibility and driver verification
Self-drive rentals are available only to drivers who meet our eligibility requirements, including minimum age, a valid driver's licence, identification, and acceptable insurance. Our current requirements are summarised in our FAQ and confirmed with your quote and rental agreement; some vehicles carry stricter requirements than others.
You agree to give us accurate, current information and genuine documents. Our team reviews every document by hand, and uploading a document does not mean you are approved. We may decline or cancel a request where a driver doesn't meet our requirements, where information can't be verified, or for any other lawful reason.
04Reservations, availability and confirmations
A request sent through the Website is an inquiry only. It does not reserve a vehicle or a chauffeur, and the vehicle remains available to others until our team confirms your booking directly with you. The email receipt you receive after sending a request confirms only that we received it.
A booking is confirmed only when a member of our team tells you it is and any requirements set out in your quote and rental agreement have been met. Requests for delivery, alternate drop-off locations, particular vehicles or special arrangements are subject to our approval.
05Pricing, deposits, payments and taxes
We don't publish rates on the Website. Pricing is provided in a quote for your specific rental or trip. A security deposit may be required; the amount varies by vehicle and renter and is confirmed with your quote. Applicable taxes, delivery charges and other charges, and the timing and method of payment, are set out in your quote and rental agreement.
06Cancellations, refunds and no-shows
Cancellation terms are summarised in our FAQ and set out in full in your quote and rental agreement, which also govern refunds, deposits and missed or late pickups. To change or cancel a request, contact our team using the details below.
08Traffic laws and prohibited activities
All renters are required to operate rental vehicles responsibly and obey all applicable local, state, and federal traffic laws.
- Traffic Laws: All posted speed limits, traffic signals, and roadway regulations must be followed at all times.
- No Off-Roading: All rental vehicles, including SUVs, trucks, Jeeps, and Ford Broncos, are strictly prohibited from off-road driving. This includes trails, sand dunes, desert terrain, mud, rocky paths, and other unpaved recreational areas.
- No Reckless Driving: Street racing, drifting, burnouts, donuts, reckless driving, and any other dangerous vehicle operation are strictly prohibited.
- Vehicle Responsibility: Renters are responsible for violations, fines, damage, and applicable fees resulting from prohibited vehicle use, subject to the rental agreement and applicable law.
These rules apply to every vehicle in our fleet, including vehicles with factory off-road capability such as the Ford Bronco, Toyota Tacoma TRD Off-Road and Mercedes-Benz G-Class. Vehicles must remain on approved public roadways.
09Vehicle condition, care and damage
You agree to take reasonable care of the vehicle, return it in the condition you received it apart from normal wear, and report any damage, warning lights or mechanical issues to us promptly. Renters may be responsible for damage, loss and related charges under their signed rental agreement and applicable law.
10Accidents, breakdowns, citations, tolls and parking
In an accident, make sure everyone is safe, contact emergency services and the police where required by law, and notify us as soon as possible. If the vehicle breaks down or shows a fault, stop driving when it is safe to do so and contact us. Don't arrange repairs or towing without our approval unless it's an emergency.
Renters are responsible for traffic citations, camera violations, tolls, parking violations, towing and impound charges incurred during the rental, under their rental agreement and applicable law. We may share renter information with the issuing authority as described in our Privacy Policy.
11Insurance
Self-drive renters must carry personal auto insurance and provide proof of it, with coverage that meets Arizona legal requirements and the coverage requirements we confirm for your rental. Our current requirements are summarised in our FAQ. Reviewing your insurance documents is not advice about, or a guarantee of, your coverage — check with your insurer what your policy covers. Any coverage we provide, if any, applies only as stated in your rental agreement.
12Chauffeur service
Chauffeur trips are driven by our own drivers and are subject to availability and confirmation by our team. Passenger numbers are limited by the seating in the vehicle, and luggage by its space. Requested stops, vehicles, timings and routes are requests until confirmed.
Passengers must follow applicable laws, including seat-belt laws, follow the driver's safety instructions, and treat the vehicle and driver with respect. Passengers may be responsible for damage they cause to the vehicle. Our driver may decline to begin or continue a trip if it can't be completed safely or lawfully.
13Vehicle availability and substitutions
Vehicles shown on the Website are examples of our fleet and are not guaranteed to be available on any date. Photos are of our vehicles but may not show every current detail. If a confirmed vehicle becomes unavailable, we will tell you as soon as we can and may offer a comparable alternative, which you may accept or decline. Your rental agreement governs what happens to any payments in that case.
14Intellectual property and website content
The Website and its content — including the FLYBY EXOTICS name and logos, photography, text and design — belong to Flyby Exotics or its licensors. You may view and share pages for personal, non-commercial purposes, but you may not copy, reproduce, modify or use our content for commercial purposes without our written permission. Vehicle makes, models and badges are trademarks of their respective owners.
15Website availability and third-party services
We try to keep the Website accurate and available but don't guarantee that it will be uninterrupted, error-free, or that all information is complete or current. We may change, suspend or discontinue any part of it at any time.
The Website relies on third-party services, such as hosting, storage, sign-in and email delivery, and may link to other websites. We aren't responsible for third-party services or sites we don't control.
You agree not to misuse the Website, including by submitting false requests or documents, attempting to access accounts or data that aren't yours, or interfering with its operation.
16Disclaimers and limitation of liability
To the extent permitted by law, the Website is provided “as is” and “as available,” without warranties of any kind, express or implied.
To the extent permitted by law, Flyby Exotics is not liable for indirect, incidental, special or consequential damages, or for lost profits or data, arising from your use of the Website. Liability relating to a rental or chauffeur trip is governed by the applicable rental agreement and the law. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Arizona law.
17Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Flyby Exotics and its owners, employees and drivers from claims, losses and reasonable costs, including legal fees, arising from your breach of these Terms, your misuse of the Website, or prohibited use of a vehicle by you or anyone you allow to drive it.
18Arizona law and resolving disputes
These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. If you have a concern, please contact us first so we can try to resolve it informally. If we can't, any dispute relating to these Terms or the Website will be brought in the state or federal courts located in Maricopa County, Arizona, unless your rental agreement or applicable law provides otherwise.
19Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page shows when they last changed. The version in effect when you send a request applies to that request; continuing to use the Website after a change means you accept the updated Terms.
